Payment, Sales and Delivery Information

In a purchase made in the Orinium store, the seller is not Orinium. Payment is taken through the Tebex Checkout infrastructure, and Tebex, in its capacity as 'Merchant of Record', sells the product to the player IN ITS OWN NAME.

For this reason, the distance sales agreement relating to the sale, the prior information, tax (VAT and similar sales taxes) and statutory refund obligations belong to Tebex Limited (United Kingdom). At the payment step, Tebex's own prior information text and terms of sale are displayed and accepted.

Orinium's role is twofold: (a) the provider of the digital content sold to Tebex, and (b) the operator of the game service that assigns the purchased content to the player's account on the Minecraft server.

Tebex's terms of sale and privacy policy are published on Tebex's own pages. This document, in turn, sets out Orinium's delivery and in-game use commitments.

This information explains the rights and obligations of the parties in the process of ordering the digital content listed in the Orinium store (Orinium Points / OP credit packages), the collection of its price by Tebex, and the assignment of the content to the in-game account.

The products offered for sale are not physical goods; they are digital in-game content valid on the Minecraft server (Orinium Points). No shipping or physical delivery is made.

Product prices are shown in United States dollars (USD) and excluding tax. The applicable taxes are calculated and added by Tebex at the payment step according to the buyer's country.

The final total amount to be collected is shown on Tebex's payment page, including taxes. Please check this amount before completing the order.

Orinium reserves the right to make changes to prices, campaigns and the content of credit packages. Such a change is not applied retroactively to completed orders.

The order is created when a product is selected in the store and the order form is submitted; the sale, however, is concluded when the payment is confirmed on Tebex's payment page.

Payment is made by credit card, debit card and the other local payment methods offered by Tebex. Orinium does not see or store card details.

If the payment is not confirmed, the order is not created and the content is not assigned.

Following payment confirmation, the content is assigned to the Minecraft account stated in the order form automatically and, as a rule, instantly. In cases where automatic delivery cannot be carried out, it is assigned within twenty-four (24) hours at the latest.

The account to which delivery is made is the Minecraft username specified in the order form. The buyer is responsible for the consequences arising from the username being entered incorrectly, incompletely or as belonging to someone else; the remedies in Article 7 are reserved.

If delivery is delayed due to server maintenance, technical failure or force majeure, the period begins to run from the moment the obstacle is removed.

For products of a digital content nature, the right of withdrawal may not be exercised pursuant to Mesafeli Sözleşmeler Yönetmeliği m. 15/1-ğ: 'The right of withdrawal may not be exercised in contracts concerning services performed instantly in an electronic environment or intangible goods delivered instantly to the consumer.'

In order for this exception to apply, the buyer must be explicitly informed on this matter BEFORE the order and their approval must be obtained. The checkbox in the order form is the confirmation of this information.

The final assessment regarding the right of withdrawal and, where applicable, the addressee of a refund request is Tebex, which is the party to the sale.

Orinium is obliged to provide the content in full in the following cases:

• If the payment was confirmed but the content was not assigned within 24 hours, the content is assigned manually when the support channel is contacted.

• If the content was assigned to another account because the username was entered incorrectly and the credits have not yet been spent, it is transferred to the correct account if an application is made within 48 hours of the purchase.

• If the content cannot be provided at all for a technically impossible reason, the payment is refunded through Tebex.

Since the payment was received by Tebex and Tebex is the Merchant of Record, chargeback processes are carried out by Tebex.

For content that has been delivered, Orinium does not claim both the product and its price through an unjustified chargeback. However, records concerning transactions that carry a suspicion of fraud are retained within the scope of 5651 sayılı Kanun and the relevant legislation, and recourse may be had to the competent authorities.

If the order price has been refunded by Tebex, the unused Orinium Points corresponding to that order may be reclaimed. Purchases made previously and unrelated to this order are not affected.

To use the service and make a purchase, one must be at least thirteen (13) years old. For users under the age of eighteen (18) to be able to make a purchase, the consent of a parent or legal guardian is mandatory.

In expenditures made on behalf of a user who is not of legal age, the parent or legal guardian is deemed to have declared that they gave consent before the order and is responsible for the expenditure.

If it is determined that consent was not given, a refund process is initiated with Tebex for the unused credits.

Orinium exercises reasonable commercial care for the operation of the server; however, it does not guarantee uninterrupted and error-free service.

If a decision is taken to terminate the service entirely, this decision is announced through the ordinary announcement channels at least thirty (30) days in advance.

During this period, users may spend their existing Orinium Points balances in-game. No cash refund is made for unused balances on the closure date; the balance is kept open for spending until the closure date.

New purchases made AFTER the closure announcement are not covered by this provision; such purchases are refunded through Tebex.

Natural disaster, war, epidemic, cyber-attack, infrastructure provider outage, electricity or internet outage, legislative change and similar circumstances beyond the control of the parties are deemed force majeure.

During force majeure, obligations are suspended and are performed within a reasonable time after the obstacle is removed.

Detailed information about the personal data processed during the order and delivery process (Minecraft username and UUID, order record, IP address and access logs) is set out in the KVKK and GDPR Information Notice and the Privacy Policy.

The card and invoicing data collected during the payment process are processed by Tebex Limited under its own data controllership.

In disputes relating to the sale, the addressee is Tebex Limited, which is the party to the sale.

In disputes relating to delivery, in-game credit use and the operation of the service, the addressee is Orinium. The buyer first applies to the support channels; if no result is obtained, they may apply to the Consumer Arbitration Committees at their place of residence for disputes below the monetary limit announced annually by the Ministry of Trade, and to the Consumer Courts for disputes above this limit.

This document is subject to Turkish law. Mandatory protections arising from the law of the consumer's place of residence are reserved.
